Creator Agreement

This Creator Agreement ("Agreement") is between you ("Creator," "you") and Spinhub Limited ("Spinhub," "we," "us") and governs your use of Spinhub as a content creator. This Agreement supplements our Terms of Service, which continue to apply to your use of Spinhub.

1. Becoming a Creator

1.1 Eligibility Requirements

To become a Creator on Spinhub, you must:

  • Be at least 21 years old
  • Have the legal capacity to enter binding contracts
  • Complete our enhanced verification process
  • Not be prohibited by your local laws
  • Not have been previously banned from Spinhub

1.2 Verification Process

  • Identity verification through Stripe's KYC process
  • Proof of current address (utility bill, bank statement)
  • Tax identification numbers

2. Your Content

2.1 Content Ownership

You Retain Ownership

  • You own all intellectual property rights in your content

Your Representations

You represent and warrant that:

  • You own or have all necessary rights to your content
  • Your content doesn't infringe any third-party rights
  • You have written permission from all participants
  • Your content complies with all applicable laws
  • You can grant the licenses in this Agreement

2.2 License Grant to Spinhub

You grant Spinhub a license to:

Platform Operations

  • Host, store, and cache your content
  • Display content to your authorized supporters
  • Create thumbnails, previews, and clips
  • Transcode videos for different devices
  • Distribute via content delivery networks
  • Make security and backup copies

Platform Features

  • Include in search and discovery features
  • Generate automated captions/translations
  • Create recommendation algorithms
  • Display in creator showcases (with consent)
  • Use in platform improvements

License Terms

This license is:

  • Non-exclusive (you can use content elsewhere)
  • Worldwide
  • Royalty-free
  • For the duration your content is on Spinhub
  • Terminates 30 days after content deletion

2.3 Content Standards

All content must comply with our Community Guidelines and:

General Requirements

  • Be accurately described and labeled
  • Meet quality standards you promise
  • Include required disclosures
  • Respect supporter expectations
  • Not mislead or deceive

NSFW Content Labeling - CRITICAL REQUIREMENT

  • You MUST accurately label ALL NSFW/adult content
  • Mislabeling is a serious violation with immediate consequences
  • This protects minors and maintains platform integrity
  • When uncertain, always label as NSFW
  • Applies to all content types: images, videos, text, streams
  • Violations result in: Warning → Suspension → Permanent ban

Adult Content Requirements

If creating adult/NSFW content:

  • All participants must be 21+ with verification
  • Maintain 2257 records (or EU equivalent)
  • Written consent from all participants
  • Proper labeling and age-gating
  • Compliance with payment processor rules
  • No content involving minors in any context

2.5 Authority to Process Transactions

Important: This section grants Spinhub the authority to handle all payment operations on your behalf as part of our marketplace model.

By using Spinhub as a creator, you grant Spinhub authority to:

Transaction Processing

  • Act as the merchant of record for all your transactions
  • Process payments from supporters in Spinhub's name for your benefit
  • Handle all payment-related customer service inquiries
  • Make decisions on refunds and disputes (with amounts deducted from your earnings)
  • Serve as the sole contact point for payment processors and financial institutions
  • Represent your interests in all platform financial matters

Scope of Authority

  • This authorization is limited to platform transactions only
  • Does not extend beyond the scope of the Spinhub marketplace
  • Applies to all monetization methods you choose to use
  • Includes subscriptions, tips, pay-per-view content, and any future payment types
  • Covers all payment-related communications with supporters

Financial Responsibility

You acknowledge that:

  • While Spinhub handles all payment operations, you remain financially responsible for refunds
  • Refund amounts will be deducted from your earnings
  • Spinhub's decisions on disputes and refunds are final
  • You must maintain sufficient balance or future earnings to cover potential refunds
  • This structure ensures compliance with financial regulations while protecting all parties

As an independent creator, you are responsible for:
